1. Agreement to Terms

These Terms of Service ("Terms", "Agreement") constitute a legally binding agreement between you ("User", "you", "your", "Parent", "Guardian") and MJ Solution Co., Ltd. (주식회사 명진솔루션) ("Company", "we", "us", "our") regarding your use of the Eye Guard mobile application ("App", "Service").

2. Acceptance of Terms

By using Eye Guard, you acknowledge that you:

• Are at least 18 years old OR are a parent/legal guardian of a child.
• Have the legal authority to enter into this Agreement.
• Have read, understood, and agree to be bound by these Terms.
• Agree to comply with all applicable laws and regulations.

3. Description of Service

Eye Guard is a mobile application designed to:

• Monitor the distance between a child's eyes and their mobile device screen.
• Provide real-time audio and visual alerts when the device is held too close.
• Help promote healthy digital habits and prevent eye strain.
• Provide local parental control features including Android device admin protection.
• Offer usage analytics to help parents monitor screen habits (Exclusive to the Free Plan).

4. Parental Consent and Responsibility

4.1 Parental Supervision Required

Eye Guard is designed for use on children's devices under parental supervision and control. By using this app:

• You confirm that you are the parent or legal guardian of the child using the device.
• You consent to the app's features and functionality on behalf of the child.
• You are responsible for all activities that occur on the device where the app is installed.
• You agree to monitor your child's use of the application.

4.2 COPPA Compliance

We comply with the Children's Online Privacy Protection Act (COPPA). We do not knowingly collect personal information from children under 13 over the internet. All app setup and configuration must be performed locally by a parent or guardian.

5. App Setup and Device Security

5.1 Local Security

• Eye Guard does not require an online user account or email registration. All settings are stored locally on your device.
• You are entirely responsible for maintaining the confidentiality of your locally set parental PIN.
• We are not liable for any loss or damage arising from your failure to protect your PIN or device.

5.2 Device Admin Permissions

Eye Guard requests Android Device Administrator permissions to prevent children from circumventing or uninstalling the app. By granting these permissions, you understand that:

• The app cannot be easily uninstalled or disabled without parental PIN verification.
• This is a security feature strictly to ensure continuous eye protection.
• You can revoke these permissions using your parental PIN at any time within the app settings.

6. Subscription Plans and Payments

6.1 Available Plans

Free Plan:

• Limited to 20 warning alerts per day.
• Includes the exclusive Eye Health Analytics feature (Charts and usage tracking).
• Free forever, no credit card required.

Premium Plans (No Limits, Unlimited Protection):

• 1 Month: Unlimited continuous protection, renews monthly.
• 6 Months: Unlimited continuous protection, billed every 6 months.
• 1 Year: Unlimited continuous protection, billed annually.
• Lifetime: One-time payment, unlimited continuous protection forever.

6.2 Payment Processing

• All payments are processed entirely through Google Play Billing.
• Prices are displayed in your local currency.
• Subscriptions automatically renew unless cancelled before the renewal date.
• You can manage or cancel subscriptions exclusively through your Google Play account settings.

6.3 Refund Policy (48-Hour Guarantee)

All Purchases (Subscriptions and Lifetime Plans):

• All payments and refunds are processed entirely and strictly by Google Play.
• If you are not satisfied with your purchase, you may request a refund directly through the Google Play Store within 48 hours of the original purchase.
• Google Play will automatically process valid refund requests within this 48-hour window according to their standard policies.
• MJ Solution Co., Ltd. does not process manual refunds directly. All refund requests must be routed through the Google Play support system.

6.4 Price Changes

We reserve the right to modify subscription prices. Any price changes will:

• Be communicated to you via Google Play at least 30 days in advance.
• Not affect your current subscription until the next renewal period.
• Allow you to cancel before the new price takes effect.

7. License and Restrictions

7.1 Limited License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the Eye Guard app on compatible Android devices.
• Use the app solely for personal, non-commercial purposes.
• Use the app to protect your child's vision as intended.

7.2 Prohibited Uses

You agree NOT to:

• Reverse engineer, decompile, or disassemble the app.
• Modify, adapt, or create derivative works of the app.
• Remove or alter any copyright, trademark, or proprietary notices.
• Use the app for any illegal or unauthorized purpose.
• Attempt to hack, bypass, or disable the parental control features.
• Distribute, sell, or transfer the app to third parties.

8. Intellectual Property Rights

All intellectual property rights in the Eye Guard app, including but not limited to software code, algorithms, architecture, user interface design, graphics, trademarks, logos, and brand names, are owned by MJ Solution Co., Ltd. or our licensors. These Terms do not grant you any ownership rights.

9. Privacy and Data Protection

Your privacy is important to us. Our collection and use of local information are governed by our Privacy Policy, which is incorporated into these Terms by reference.

Key Privacy Points:

• We do NOT collect facial recognition data, photos, or videos.
• All AI processing happens entirely offline on your device using Google ML Kit.
• No personal data is transmitted to our servers or third parties.

You agree to indemnify, defend, and hold harmless MJ Solution Co., Ltd., its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use or misuse of the app.
• Your violation of these Terms.
• Your violation of any third-party rights.
• Any unauthorized use of your device or parental PIN.

13. Term and Termination

13.1 Term

These Terms remain in effect while you use the Eye Guard app.

13.2 Termination by You

You may terminate this Agreement at any time by:

• Uninstalling the app from your device (which deletes all local app data).
• Canceling any active subscriptions through Google Play.

13.3 Termination by Us

We reserve the right to suspend or terminate your access to the app if:

• You violate these Terms.
• We suspect fraudulent, abusive, or illegal activity.
• Required by law or government request.

13.4 Effect of Termination

Upon termination, your license to use the app immediately ceases. You must uninstall the app from all devices. Provisions that should survive (privacy, liability, disputes) will remain in effect.

14. Updates and Modifications

14.1 App Updates

We may release updates, upgrades, or new versions of the app via Google Play. You agree that updates may be required for continued functionality and are subject to these Terms.

14.2 Terms Modifications

We reserve the right to modify these Terms at any time. When we do, we will update the "Last Updated" date. Continued use after changes constitutes acceptance.

15. Governing Law and Disputes

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Korea, without regard to its conflict of law provisions.

15.2 Dispute Resolution

Any disputes arising from these Terms or your use of the app shall be resolved as follows:

• Informal Resolution: Contact us first at mjosc@mjosc.co.kr to attempt good-faith resolution.
• Mediation: If informal resolution fails, disputes should be submitted to mediation.
• Arbitration/Litigation: Unresolved disputes will be submitted to the exclusive jurisdiction of the courts of Cheongju-si, Chungcheongbuk-do, South Korea.

15.3 International Users

If you access the app from outside South Korea, you are responsible for compliance with local laws.

16. Miscellaneous

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and MJ Solution Co., Ltd.
• Severability: If any provision is found invalid, the remaining provisions will remain in effect.
• Waiver: Our failure to enforce any right does not constitute a waiver of that right.
• Language: These Terms are provided in English. Translations may be provided for convenience, but the English version shall prevail in case of any conflict.
